Using your FSA or HSA for braces and Invisalign before year-end in NJ starts with your 2026 plan rules. Your flexible spending account (FSA) may have a deadline; your health savings account (HSA) balance does not expire at year-end. Check when your administrator will reimburse each orthodontic treatment payment.
If you plan to start in November or December, get a treatment plan and insurance estimate first. Ask how your FSA handles down payments before putting pre-tax funds toward treatment costs. A 2027 FSA may cover eligible 2027 expenses, but it cannot automatically cover a 2026 charge.
Can you use your FSA or HSA for braces and Invisalign?
Yes, braces and Invisalign clear aligners can qualify as medical expenses for orthodontic treatment of teeth and jaw bones. Eligible spouses and dependents may also qualify, subject to account rules.
“Braces can qualify as a medical expense.” – IRS Publication 502
Subtract dental insurance payments first; you cannot claim the same bill twice. Use a health care FSA, not a dependent-care FSA. A limited-purpose FSA alongside an HSA may also cover eligible dental expenses.

Which year-end deadline applies in 2026?
Your FSA may not end on December 31, 2026. That date applies to a calendar-year plan with no service grace period. An employer can set a different plan year or offer a limited carryover or grace period. A claims run-out period gives you extra time to submit older claims, not extra time to incur new expenses. A plan generally cannot offer both a carryover and a grace period for the same year.
An FSA grace period can last up to 2½ months if your employer offers one. For a 2026 plan year, the IRS sets the maximum permitted health FSA carryover at $680; your employer may allow less or none. The IRS explanation of FSAs and HSAs explains why HSA balances remain available from year to year.

Ask your FSA administrator about deadlines and prepayments. A December card charge does not make all 2027 treatment a valid 2026 claim; you may need a contract, payment schedule or proof of payment.
The IRS guidance on orthodontic prepayments permits an FSA to reimburse care in advance only to the extent you have paid in advance. Your plan can decline advance reimbursement.
An HSA balance carries forward without a year-end spending deadline. Use it for qualified expenses incurred after you established the account, and keep receipts. December alone is no reason to rush an HSA payment.
How to use your FSA or HSA for braces and Invisalign before year-end
-
Check your 2026 balance and rules. Distinguish the spending window from the claims deadline. Ask whether a down payment for care extending into 2027 qualifies and what proof is needed.
-
Get a written estimate. Request the proposed treatment, patient name, total fee, insurance benefit, down payment and installment dates. A complimentary consultation in Passaic can help you compare braces and Invisalign.
-
Coordinate insurance first. Claim only eligible out-of-pocket costs; ask how installments from your insurance company affect reimbursement.
-
Pay and retain proof. If approved, pay within your plan’s window by benefits card or another method. Keep the contract, itemized receipt, payment confirmation and any explanation of benefits.
-
Plan the rest separately. A 2027 FSA may cover eligible expenses under its own rules. Ask about monthly financing, including available 0% APR options. Never claim a payment from both years’ FSAs.
What a split payment could look like
If your administrator approves a 2026 down payment on a signed contract, that eligible payment may come from your 2026 FSA. Qualifying installments in 2027 may fit a 2027 FSA or financing plan. The administrator’s rules and your payment schedule determine which account can cover each charge.

FAQ
Can HSA funds be used for braces?
Yes, braces are generally a qualified orthodontic expense when paid for an eligible person with HSA funds. Keep the itemized receipt and do not claim any portion already paid by insurance or another tax-advantaged account. Your unused HSA balance carries forward.
Are braces tax deductible?
Eligible, unreimbursed orthodontic costs may count as medical expenses if you itemize deductions and meet the applicable federal threshold. You cannot deduct amounts already paid tax-free through an FSA or HSA. Whether a deduction helps depends on your full tax situation.
